Terms of Service

[Chapter 1. General Provisions]

Article 1 (Purpose)

The purpose of these Terms of Use("Terms") is to specify all the conditions and other requirements concerning access to, and use of, all Internet-related services("Services") provided to the user("Member" or "Members") by Yemyung Graduate University("University").

Article 2 (Definitions)

The following definitions shall be used in these Terms.

  1. "Member" is a user who agrees to these Terms for using Services by offering personal information to the University.
  2. "Use Agreement" signifies all contracts concluded between University and Member in connection with the use of Services.
  3. "Membership Registration" is a conclusion of the use agreement created by filling out the relevant information in the prescribed application form and agreeing to these Terms.
  4. "ID" is a unique combination of letters and numbers selected by the Member and approved by the University for the user identification and the use of Services.
  5. "Password" is a unique combination of letters and numbers set up by the Member and registered in the Services of the University to confirm the identity of a user who can be differentiated by ID.
  6. "Termination(Membership Withdrawal)" is an act that University or Member ends the use agreement.
Article 3 (Notification and Modification of Terms)
  1. The University shall post the contents of these Terms in a menu at the bottom of the initial page of Services.
  2. If a reasonable cause arises, to the full extent of the law, the University reserves the right to modify these Terms without a prior notice, and the modified Terms shall be effective when publishing notice of any such modifications on the initial page of Services.
  3. If the Member does not agree to the modified Terms, a request for the termination of the use agreement(membership withdrawal) shall be made. By continuing to access the Services, the Member signifies his or her agreement to be bound by them.
Article 4 (Other Regulations)
  1. Matters not specified in these Terms shall be governed by the Telecommunications Act, the Telecommunications Business Act, the Act on Promotion of Information Network Utilization and Privacy Protection, and other relevant regulations and precedents.

Chapter 2. Entering into the Use Agreement

Article 5 (Establishment of Use Agreement)
  1. The use agreement shall be established when the Member consents to these Terms and the University approves the application for using the Services.
Article 6 (Restriction of Use Agreement)
  1. The University may restrict applications for using the Services to those who fall under any of the following.
    1. An application of a user whose use agreement has been terminated in violation of laws or these Terms (However, an exception may be made in cases where three years have elapsed since the disqualification of membership and a permission for re-entry is obtained from the University.
    2. An application made in an unlawful manner using the information of other persons, not applicant’s own information
    3. An application made for illegal or commercial purposes
    4. and an application made in violation of other regulations
Article 7 (Protection and Use of Personal Information)
  1. The University shall endeavor to protect personal information of the Member in accordance with the relevant laws. Regarding the protection and use of personal information, the relevant laws and the University’s internal regulations on the personal information protection shall be applied.
  2. The University shall not make a disclosure of or provide any personal information of the Member collected for the Services to a third party. However, the Member’s personal information may be offered to a third party to the extent permitted by law in any of the following cases.
    1. Information requested by the relevant authorities in accordance with investigation purposes or procedures prescribed by the law
    2. Non-personally identifiable information for statistical uses, academic researches, or market researches
    3. Information requested by other relevant laws
Article 8 (Creation and Change of User ID)
  1. The University grants an ID to the Member in accordance with these Terms.
  2. The Member is solely responsible for the security of his or her password. The University is not responsible for any information disclosures caused by negligence of the Member in managing his or her password.
  3. n Principle, an ID of the Member is not subject to change. However, if the Member wishes to change it due to unavoidable circumstances, he or she may re-register a new ID after canceling the existing one.

Chapter 3. Obligations of the Parties to the Terms

Article 9 (the University’s Duty)
  1. The University shall not engage in any acts prohibited by laws and these Terms, or that are against public order and morality. The University shall endeavor to provide the Services in a sustained and stable manner as prescribed by these Terms.
  2. The University shall endeavor to provide convenience to the Members in the procedures and contents of the use agreement, such as entering into the agreement, modification and termination of the agreement, and so forth.
Article 10 (the Member’s Duty)
  1. In cases of the membership registration or change of information, all details provided by the Member shall be accurate and complete based on facts. If the Member provides false or other person’s information, he or she is not able to claim any rights related thereto.
  2. The Member shall comply with the provisions of these Terms, other regulations and notices of the University, and the relevant laws. The Member shall not engage in any interferences on the University’s business and behaviors damaging the reputation of the University or exposing other persons to any harm.
  3. The Member shall not impersonate any person or entity of the University and shall not engage in any unauthorized commercial activities when using the Services, and the University is not liable for the consequences thereof. The Member shall be liable for damages to the University caused as a result of such conducts, and the University may file a claim for damages against the Member through legal proceedings and shall restrict the use of the Services.
  4. The Member shall not transfer or donate the right for using the Services or his or her contractual position to other persons.
  5. The Member shall not infringe any rights including, but not limited to, the intellectual property of the University or a third party.

Chapter 4. Use of the Services

Article 11 (Provision and Modification of the Services)
  1. The University provides the Services to the Members as follows.
    1. The Services for academic and administration information of the University
    2. Information related to the academic and administration affairs
    3. All other Services solely developed by the University or contracted with other institutions
  2. The University may modify the Services prescribed in the above Section 1 and shall notify the Members of contents and date of modifications as follows.
    1. A notice will be posted on the bulletin board for at least one week when the University notifies a large number of unspecified individuals.
Article 12 (Interruption of the Services)
  1. The University reserves the right to temporarily interrupt the Services at the appointed time as a result of system inspection, extension or replacement reasons. The Services interrupted by the scheduled tasks will be notified in advance online or offline.
  2. The University reserves the right to interrupt access to the website and to interrupt the presentation of any or all of the Services, at any time and without prior notice, as a result of technical, security, control or maintenance reasons or due to electricity supply failures, a state of national emergency or to any other reason.
Article 13 (Copyright Ownership)
  1. Copyrights and other intellectual property rights for all contents and materials created by the University are bestowed upon the foregoing.
  2. Without prior consent, the Member shall not copy, transmit, publish, distribute, broadcast or commercially use materials of the Services provided by the University.
Article 14 (User Content)
  1. Posts refer to text, photos, files, hyperlinks, and so forth posted by the Members while using the Services.
  2. The University shall endeavor to ensure that the Members’ posts are not falsified, disfigured and deleted. However, in any of the following cases, a post shall be deleted without prior notice, and the membership shall be restricted, suspended or disqualified.
    1. Contents that disseminate false information with intent of defamation and slander and undermine the reputation of others.
    2. Contents that include or are linked to objectionable materials against the public order and morals.
    3. Contents that infringe copyrights or other rights of other Members or a third party.
    4. Contents that include commercial advertisements.
    5. Contents that would constitute, encourage or provide instructions for a criminal offense.
    6. Contents that would otherwise create liability or violate any local, national or international law.
  3. The University takes no responsibility and assumes no liability for any contents posted, stored or uploaded by the Members, nor is the University liable for information, data, nature, reliability or accuracy of such contents.
Article 15 (Provision of Information)
  1. The University may provide the Members with information regarding the Services by e-mail, letter, message service or telephone.

Chapter 5. Termination

Article 16 (Termination)
  1. When the Member intends to withdraw the use agreement, he or she shall apply for the termination(membership withdrawal) online.
  2. The University shall delete the Member’s registration data and/or information when terminating the use agreement. However, to the minimum extent possible in accordance with the law, the University may keep the personal information of the Members even after fulfilling the particular purpose for which it was collected.

Chapter 6. Other

Article 17 (Indemnification)
  1. The University and Member agree to indemnify each other for any claims, losses or damages, intentionally or negligently arising out of or related to use of the Services. However, the University shall not be liable for any claims, losses or damages related to use of the Services unless violating the contents prescribed the privacy policy.
Article 18 (Jurisdiction)
  1. The Member agrees that any dispute arising out or relating to these Terms will be governed by the laws of Republic of Korea and further consents that the personal jurisdiction of and exclusive venue will rest in the district or high courts located in Seocho, Seoul as the legal forum for any such dispute.

In the process of the administration and other various services for the users, Yemyung Graduate University(“the University”) is required to obtain the user’s consent to collect, use and disclose personal information as following.
